Your personal data will be processed to conclude contracts for the services of the Owner;

 

  • fulfil pre-contractual, contractual and tax obligations arising from existing relations with you;
  • comply with obligations laid down by law, regulation, Community legislation or an order of the Authority (e.g. in the field of anti-money laundering);
  • exercise the rights of the Owner, for example the right of defence in court;

 

or for

 

  • send you by e-mail, mail and/or sms and/or telephone contacts, newsletters, commercial communications and/or advertising material about products or services offered by the Owner and survey the degree of satisfaction with the quality of services;
  • allow navigation on the company website;
  • possible compilation of data collection forms to send a request for information to the data controller;

  • Studies or Companies in the field of assistance and consulting relationships;

  • In case of administrative and accounting purposes, the data may possibly be transmitted to commercial information companies for the evaluation of solvency and payment habits and/or to subjects for debt collection purposes. The subjects belonging to the above categories perform the function of Data Processor, or operate in total autonomy as separate Data Controllers;
  • companies that cooperate with us because of the affinities of the corporate objects or part of them or because of the complementarity of the action by legal entities that may qualify as suppliers and whose relationship is governed by special agreement;
  • external parties that we may make use of in the management of the contractual relationship with customers or for our own organizational needs and activities. Your personal data will also be disclosed to employees and collaborators, including external ones, specifically charged with processing (with access selected according to function). The list of external companies responsible for the processing, or rather the indication of those who operate in total autonomy as separate data controllers, will be kept up to date at the personnel office. Methods of treatment

 

The processing of your personal data will be carried out in compliance with the security and confidentiality required by the operations classified in the register and therefore for the collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data are subject to both paper and electronic and/or automated processing.

 

The Owner will process personal data for the time necessary to fulfill the above mentioned purposes and in any case for no longer than 10 years from the termination of the relationship for the Service Purposes and for no longer than 2 years from the collection of data for the Marketing Purposes.

 

Compulsory or optional nature of the provision of data and consequences of a possible refusal to respond:

 

The nature of the conferment of data on your part is mandatory for the data controller to provide the services requested. In case of refusal, therefore, it will be impossible to complete the registration process and the System Holder will not be able to fulfil the contractual obligations.

 

Data access

 

Your data may be made accessible for the purposes announced:

 

  • to employees and collaborators of the Owner or of the companies that request it for the valid maintenance of the contractual relationship with them (e.g. contracting station that asks for confirmation of subsistence of employment relationship with SEM Solution Srl employees who will have to carry out the entrusted works);
  • to the system administrator;
  • to third party companies or other subjects (by way of example, credit institutions, professional firms, consultants, insurance companies for the provision of insurance services, etc.) who carry out outsourcing activities on behalf of the Data Controller, in their capacity as external data processors.

 

Data transfer to a Third Country and/or an International Organization

 

The personal data provided will not be transferred abroad within or outside the European Union.

 

Communication of data to third parties

 

The Data Controller may also communicate your data for the purposes announced to independent data controllers such as the Supervisory Body, judicial authorities, insurance companies for the provision of insurance services, credit recovery companies as well as to those subjects to whom communication is required by law for the fulfilment of the said purposes. These subjects will process the data in their capacity as autonomous data controllers.

 

Your data may also be communicated to companies/professional studies that provide assistance, advice or collaboration to the data controller, in accounting, administrative, fiscal, legal, tax and financial matters, to public administrations for the performance of institutional functions within the limits established by law or regulations and to third party service providers to whom the communication is necessary for the performance of the services covered by the contract. Personal data is stored on company servers within the European Union. In any case, it is understood that the Owner, if necessary, will have the right to move the servers in cloud mode.

 

Nature of the provision of data and consequences of refusal to respond

 

The conferment of the data, subject to information on the methods of use and storage times, is mandatory.

 

The data subject, without prejudice to the processing operations that find their source in the law, may freely decide not to provide his or her data, or may subsequently deny the possibility of processing data already provided also limited to certain purposes: in this case, for example, while a specific contract for the performance of services remains in place, he or she may deny consent to the receipt of commercial communications and advertising material.

 

Rights of the interested party

 

As an interested party, you are entitled to:

 

 i. obtain confirmation of the existence or not of personal data concerning you, even if not yet recorded, and their communication in an intelligible form;

 

ii. to obtain indication of: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in the case of processing carried out with the aid of electronic instruments; d) the identity of the owner, managers and the representative appointed pursuant to art. 5, paragraph 2 Privacy Code and art. 3, paragraph 1, GDPR; e) the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as appointed representative in the State, managers or agents;

 

iii. get: a) the updating, rectification or, when interested therein, integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;

 

iv. oppose, in whole or in part: a) for legitimate reasons, the processing of personal data concerning you, even if pertinent to the purpose of collection; b) the processing of personal data concerning you for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication, through the use of automated calling systems without the intervention of an operator by e-mail and/or through traditional marketing methods by telephone and/or paper mail.
